A federal lawsuit has been filed against Elon Musk’s X Corp. by X Social Media LLC, an advertising agency based in Florida, alleging violations of Florida common law related to “unfair competition, trademark, and service mark infringement,” as well as the state’s Deceptive and Unfair Trade Practices Act.
The lawsuit claims that X Corp., the former Twitter, has caused marketplace confusion and a decline in revenue for X Social Media.
X Social Media, abbreviated as XSM for convenience, asserts in the complaint that it has been continuously using its registered trademark, “X SOCIALMEDIA,” since 2016. XSM contends that it has already experienced a decrease in revenue that is linked to X Corp.’s rebranding and utilization of the “X” mark.
The strength of X Social Media’s case remains uncertain. According to law professor Alexandra Roberts, the multitude of “X” trademarks in the industry could present challenges for any individual entity with an “X” brand to assert a claim against another, whether it’s Musk’s X or a company like X Social Media.
